Terms of Use for the BLACKVAPOR Club

These terms of use apply in the version valid at the time of conclusion of the contract for the use of the BLACKVAPOR Club (“BLACKVAPOR Club”), offered by Blackvapor eK, Jahnstr. 21, 74172 Neckarsulm (hereinafter “BLACKVAPOR”). They are addressed to you as the end user (“user”).

1. Content of the BLACKVAPOR Club and availability

1.1. The BLACKVAPOR Club is a free offer from BLACKVAPOR. As a member of the BLACKVAPOR Club, you will have access to various benefits depending on your type of membership.

1.2. Since this is a free service, there is no guarantee that the BLACKVAPOR Club will be available at all times. Interruptions may occur, for example due to maintenance work, technical adjustments or unforeseen faults, which may also lead to data loss. However, BLACKVAPOR will endeavour to enable the use of the club services as continuously as possible.

1.3. BLACKVAPOR reserves the right to expand, restrict or limit the services offered in the BLACKVAPOR Club. There is no entitlement to the permanent provision of certain services. BLACKVAPOR will always take the legitimate interests of the users into account.

2. Registration and conclusion of contract

2.1. To become a member of the BLACKVAPOR Club, you must register. This can be done online using the registration form on our website or as part of the ordering process in our online shop.

2.2. Registration for the BLACKVAPOR Club is only possible for natural persons who act as consumers within the meaning of Section 13 of the German Civil Code (BGB) and who are at least 18 years old.

2.3. During the registration process, your first and last name, a valid email address and a freely selectable password are specified as access data. It is expected that the information provided is complete and correct. If your data changes after registration, you are obliged to update it in your member account immediately.

2.4. By submitting the registration form, you are making BLACKVAPOR an offer to become a member of the BLACKVAPOR Club. BLACKVAPOR reserves the right to accept this offer at its own discretion.

2.5. Membership begins with the activation of your access, which will be confirmed to you by email. From this point on, you are entitled to use the benefits of the BLACKVAPOR Club.

2.6. It is not permitted to have multiple memberships in the BLACKVAPOR Club at the same time.

2.7. Your membership and the associated access data are personal and may not be passed on to third parties. Changes and additions to your personal data can be made at any time via the customer account.

3. Benefits in the BLACKVAPOR Club

3.1. As a member of the BLACKVAPOR Club, you benefit from various discounts, depending on your membership:

• Welcome discount: Immediately after registration, you will receive a voucher for a 10% discount, redeemable on purchases of €20 or more in our online shop. The voucher is valid for 6 weeks.

• Exclusive offers: Members will be informed early about special promotions and events, provided they have agreed to be contacted.

• Preferred customer service: As a club member, VIP support is available to you.

• Managing your customer data: You can manage your orders, receipts, returns and personal data at any time via your member account.

4. Term and termination

4.1. Membership in the BLACKVAPOR Club is closed for an indefinite period.

4.2. You can delete your membership at any time via your customer account or notify us of cancellation via the contact form.

4.3 BLACKVAPOR reserves the right to terminate membership or access to certain services with fourteen (14) days’ notice to the end of the month.

4.4 Both parties have the right to terminate the membership without notice for good cause.

4.5. After termination by BLACKVAPOR, you will retain the benefits of a premium membership until the regular expiration date, unless the termination was due to an important reason for which you are responsible.

4.6. If your membership account remains inactive for three years, it will be automatically closed at the end of the month.

4.7. BLACKVAPOR reserves the right to immediately block accounts in the event of serious violations (e.g. cases of fraud).

5. Data protection

The responsible handling of your personal data is of the highest priority for BLACKVAPOR. In our data protection information we provide you with comprehensive information about which data we process and for what purposes in order to provide you with the best possible offers.

6. Liability

6.1. BLACKVAPOR is not liable for slight negligence, unless it concerns damages resulting from injury to life, body or health, guarantees or claims under the Product Liability Act.

6.2 Liability for the violation of essential obligations remains unaffected, the fulfillment of which makes the proper implementation of the user relationship possible in the first place and on whose compliance one can regularly rely.

6.3. These liability rules also apply to breaches of duty by legal representatives and vicarious agents of BLACKVAPOR.

7. Changes to these Terms of Use

7.1. BLACKVAPOR reserves the right to change these terms of use with effect for the future. Such changes may in particular affect the type and scope of member benefits. You will be informed of any changes at least 30 days before they are scheduled to come into effect.

7.2. If you do not object to the changes within 30 days of receiving the notification and continue to use the BLACKVAPOR Club after the objection period has expired, the changes will be deemed accepted. If you object, membership will continue under the previous conditions, but BLACKVAPOR reserves the right to terminate the user relationship in this case. In the notification of the change, you will be informed of your right to object and the consequences.

8. Final provisions

8.1. German law applies, excluding international private law and the UN Convention on Contracts for the International Sale of Goods. This choice of law clause does not affect mandatory consumer protection provisions that apply in the country in which the user has his or her habitual residence.

8.2. Should any provision of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision shall be deemed to have been agreed that comes closest to the economic purpose of the invalid provision.

8.3 BLACKVAPOR is not willing and not obliged to participate in a dispute settlement procedure before a consumer arbitration board.
